Welcome to ChatPress.ai (“ChatPress,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of ChatPress’s software-as-a-service platform (“Service”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
Company Information
ChatPress is owned and operated by 118Group LLC, a Massachusetts limited liability company.
For legal or account-related inquiries, you may contact us at [email protected] or by mail at our registered business address, available upon request.
Account Registration and Use
- Account Responsibility: To access the Service, you must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
- Acceptable Use:
- Do not use the Service for unlawful, harmful, or fraudulent purposes.
- Do not upload or distribute content that infringes upon the rights of others.
- Do not attempt to gain unauthorized access to ChatPress systems or data.
- Do not use automated means to scrape or overload the Service.
We reserve the right to suspend or terminate accounts that violate these rules.
Subscriptions, Billing, and Payments
- Merchant of Record: All payments, billing, taxes, and refunds for ChatPress are handled by Paddle.com, which acts as the Merchant of Record for all transactions. Paddle manages checkout, invoicing, and tax compliance globally.
- Subscription Renewal: Paid subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless canceled before the renewal date. Renewal prices are the same unless otherwise communicated.
- Downgrades and Cancellations: When you downgrade to a lower paid plan, the downgrade takes effect immediately and any prorated credit from your previous plan is applied to your account for future ChatPress charges. If you cancel your subscription or downgrade to the Free plan, your paid plan will end immediately, and no credits or refunds will remain once the subscription is closed. You may manage or cancel your subscription at any time through your ChatPress dashboard or Paddle’s subscription management link provided in your billing emails.
Refund Policy
- 7-Day Refund Window: ChatPress offers a 7-day refund window for new subscriptions. Refund requests must be submitted within 7 days of the original transaction date. Refunds are processed through Paddle and returned to the original payment method.
- Paddle’s Role: Refunds may be requested directly from ChatPress or from Paddle. Paddle will process refunds in accordance with both this policy and its Buyer Terms. Paddle may process certain refunds directly when required by applicable consumer protection laws.
- Training and Processing Costs: Because ChatPress incurs processing costs for training and maintaining custom chatbots, refunds requested after the 7-day period are generally not available except in cases of verified technical failure.
Data Ownership and Usage
- User Data: You retain full ownership of any data, website content, and information you provide for chatbot training. By using the Service, you grant ChatPress a limited license to process, store, and use this data as necessary to operate and improve the Service.
- Data Retention and Deletion: Upon account closure, ChatPress permanently deletes all associated user data within 60 days. Some aggregated, anonymized data may be retained for analytics and product improvement.
- AI Outputs: You own all chatbot responses and outputs generated from your trained data. However, you grant ChatPress a limited, non-exclusive license to review and analyze those outputs internally for service improvement, debugging, quality assurance, and abuse prevention.
- Third-Party Services: ChatPress uses third-party AI systems (including models provided by OpenAI) to generate responses. ChatPress is not responsible for the accuracy, reliability, or performance of these third-party systems or for outages beyond our control.
Support and Availability
- ChatPress provides standard customer support via email at [email protected]. We aim to respond to support inquiries within 48 business hours, though response times are not guaranteed. The Service is provided “as is” and “as available,” without any uptime or performance commitments.
Intellectual Property
- The ChatPress Service, software, and associated materials are owned by 118Group LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service. Nothing in these Terms grants you any rights to our trademarks, brand elements, or proprietary technologies.
Limitation of Liability
- To the maximum extent permitted by law: ChatPress is not liable for any indirect, incidental, or consequential damages. ChatPress’s total liability for any claim shall not exceed the total amount you paid for the Service in the six (6) months preceding the claim. The Service is provided without any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Indemnification
- You agree to indemnify and hold harmless ChatPress, its affiliates, and its employees from any claims, losses, or damages arising from your use or misuse of the Service, any content you submit or train through the Service, or your violation of these Terms or applicable laws.
Termination
- By You: You may delete your account and terminate your subscription at any time through your dashboard or by contacting us at [email protected].
- By ChatPress: We may suspend or terminate your account at any time for any reason, including violations of these Terms or technical misuse. Upon termination, access to the Service is immediately revoked and all associated data is deleted within the retention window described in Data Ownership and Usage.
Dispute Resolution
- Before initiating any formal legal action, both you and ChatPress agree to make a good faith effort to resolve disputes informally by contacting each other via email. If the dispute cannot be resolved within 30 days, either party may pursue legal remedies under Massachusetts law.
Governing Law
- These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles.
Modifications
- We may update these Terms at any time. Changes take effect immediately upon posting on the ChatPress website. Your continued use of the Service after any update constitutes acceptance of the revised Terms.
Entire Agreement
- These Terms constitute the entire agreement between you and 118Group LLC regarding your use of ChatPress. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
